The rules for public pools in NSW

In NSW, pools and spas used by the public, guests, residents or members are regulated under the Public Health Act 2010 and the Public Health Regulation 2022. Schedule 1 of the Regulation sets the operating requirements, including:

  • an automated or continuous metered disinfectant dosing system, using chlorine or bromine
  • minimum disinfectant levels (for example, at least 1.0 mg/L free chlorine for an outdoor pool and 2.0 mg/L for a spa, higher when pH is above 7.6 or stabiliser is used)
  • pH between 7.0 and 7.8 for chlorine pools (7.0 to 8.0 for bromine)
  • daily testing of disinfectant and pH, and more often when the pool is busy
  • records of test results kept for at least six months

NSW Health’s Public Swimming Pool and Spa Pool Advisory Document sits alongside the law, with guidance on disinfection, microbiological criteria and managing risks such as Cryptosporidium. Councils register public pools and inspect them, so they need to be notified of your pool and of changes within seven days.

Frequently asked questions

Does my pool count as a public pool?

Under the NSW Public Health Act 2010, pools and spas used by the public, guests, members or residents (for example at motels, holiday parks, strata complexes, schools and gyms) are generally regulated as public swimming pools or spa pools. Your local council can confirm whether yours is, and must be notified of it.

How often does the water need testing?

Schedule 1 of the Public Health Regulation 2022 requires the disinfectant level and pH to be tested every day, before the pool opens (and also recorded during operation where an automated dosing system is used), with more frequent testing when the pool is busy. That daily testing is the pool operator’s responsibility. We add independent checks monthly or more often, keep your logbook in order and help your staff with their daily testing.

How long do we have to keep records?

The Regulation requires test results to be recorded and kept for at least six months. NSW Health suggests recording daily monitoring on a daily sample log sheet. Council officers may ask to see them during an inspection.

Are you accredited or certified by NSW Health?

No. NSW Health doesn’t accredit pool service companies. We maintain and test your pool in line with the published requirements. Microbiological samples are analysed by an accredited laboratory, which we can help you arrange.
